PLAYER WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT

I, the undersigned, acknowledge, agree and represent that:

1. Voluntarily and of my own free will, I elect to participate as a member of the Gwinnett Senior Softball, Inc. (GSS) and its Metro Atlanta Senior Softball League (MASSL). It has not been requested or required by the GSS in any way that I undertake participation in member activities.

2. There are certain risks and hazards involved in participating as a member that may result in serious bodily injury, including but not limited to permanent disability, paralysis, and death (“Risks”).

3. Risks may be caused by my own actions or inactions, the actions or inactions of others, the conditions under which the member activities takes place (such as weather, playing conditions, equipment, etc.), and/or the negligence of GSS and/or MASSL.

4. The very nature of softball is hazardous and risky, including but not limited to, the acts of pitching, fielding, throwing and catching the ball, swinging the bat, running, jumping, stretching, sliding, diving, and collisions with other players and stationery objects, all of which can cause serious injury or death to me and to other players.

5. A batted softball and sliding into a base is dangerous to me and other players and may result in serious injury or death.

6. There may be other risks and social and economic losses involved with participating as a member that are either not known to me or are not readily foreseeable at this time.

7. I am qualified to participate as a member. I am in good health and have no physical condition that would prevent me from participating as a member of the GSS.

Further, I, the undersigned, acknowledge, agree and represent that in consideration for being permitted to participate in activities arranged or sponsored by the GSS or a team thereof:

1. If at any time I observe a condition which I consider to be unacceptably hazardous or dangerous to myself or others, I will notify all persons participating in the activity and will refuse to take part in the activity.

2. I voluntarily elect to accept and assume all risks of injury incurred or suffered by me (a) while practicing, (b) while playing as a member of my team, (c) while serving in a non-playing capacity as a team member during practice or play by other teams or by players on my team, (d) while on or upon the premises of any and all the fields arranged for my team or league for practice or play, and (e) while participating in member activities at any location.

3. For myself, my representatives, agents, successors, heirs, and assigns, I hereby release and forever discharge the GSS, its officers, directors, members, agents, employees and volunteers thereof, and the field owner or other entity designated, their officers, agents, servants, associations and employees, and any person or entity connected with the GSS, the team, league, or field (each considered a “Released Party”), from all liabilities, claims, judgments, actions, demands, suits, or possible causes of actions whatsoever that I may have or claim to have against the Released Parties for any damages or injuries whatsoever, including but not limited to death and injuries to the person or property, real or personal, caused by or alleged to be caused by, or arising out of or alleged to arise out of, my participation in the GSS activities, whether known or unknown, developed or undeveloped, anticipated or unanticipated, discoverable or undiscoverable, including damages or injuries arising from the negligence of a Released Party.

4. I further indemnify, save and hold harmless the Released Parties from all claims, suits, or losses of any type, including but not limited to all litigation expenses, attorney’s fees, damage awards and/or judgments of any kind, which any Released Party may incur as the result of any claims, suits, or losses released herein or otherwise arising out of the negligence of a Released Party.

I further acknowledge, agree and represent that I have read and that I understand each and every one of the above provisions of this waiver, release of liability and indemnification agreement and I hereby agree to abide by their terms and conditions notwithstanding that I have given up substantial rights by signing this agreement, which I do as my free act without inducement or assurance of any nature.
